Terms of Use

Effective date: 27 October 2026
Last updated: 27 October 2026

These Terms of Use (“Terms”) govern access to and use of Kinoder, including its websites, applications, creative tools, AI-assisted features, rendering services, publishing tools, and related services (collectively, the “Service”).

The contracting service provider (“Kinoder,” “we,” “us,” or “our”) is the legal entity identified on your order form, invoice, payment receipt, or other commercial document. If you use Kinoder on behalf of an organization, you confirm that you have authority to bind that organization, and “you” includes that organization.

By creating an account, purchasing Kino Credits, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority where you live, and able to enter into a binding contract. You must provide accurate account information and keep it current.

You are responsible for safeguarding your credentials, multi-factor authentication methods, sessions, and all activity under your account. Tell us promptly at [email protected] if you suspect unauthorized access. You may not share an account in a way that bypasses an applicable plan, seat, or access restriction.

2. The Service

Kinoder helps users plan, generate, edit, render, organize, and publish audiovisual content. Features may include projects and revisions, subjects, storyboards, prompts and scripts, templates, AI-generated images or video, face-swap tools, rendering, storage, Kino Credits, and connections to third-party publishing or identity providers.

Features, models, providers, limits, and supported destinations may change. Preview, beta, or experimental features may be modified or withdrawn and may produce incomplete or unexpected results.

3. Your content and permissions

“Your Content” means prompts, scripts, images, videos, audio, likenesses, files, project data, and other material you submit to or create with the Service.

You retain any rights you have in Your Content. You grant Kinoder and its service providers a worldwide, non-exclusive, limited license to host, copy, process, transmit, modify, render, and display Your Content only as needed to operate, secure, improve, support, and provide the Service, fulfill your requests, and comply with law. This license ends when the content is no longer needed for those purposes, subject to backups, legal obligations, dispute preservation, and records we are required to retain.

You represent that you have all rights, permissions, releases, and lawful bases needed for Your Content and its intended use. This includes permission to use any person’s image, voice, likeness, personal data, copyrighted work, trademark, or confidential material.

4. AI-assisted and generated content

AI outputs are probabilistic. They may be inaccurate, incomplete, offensive, similar to material produced for others, or unsuitable for a particular purpose. You must review outputs before using or publishing them.

Kinoder does not guarantee that an output is unique, non-infringing, factually accurate, or eligible for intellectual-property protection. You are responsible for determining whether your use of inputs and outputs is lawful and appropriate, including any disclosure, consent, labeling, or human-review requirements.

Do not use a person’s face, voice, or likeness without authorization. Do not present synthetic content as authentic when doing so could mislead, defraud, impersonate, or harm another person.

5. Acceptable use

You may not use the Service to:

  • violate any law, regulation, court order, or third-party right;
  • exploit or endanger children, or create sexual content involving minors;
  • create non-consensual intimate imagery or sexualized depictions of a person;
  • impersonate, defraud, deceive, harass, threaten, stalk, or defame;
  • create or distribute malware, phishing, spam, or instructions intended to facilitate wrongdoing;
  • interfere with, overload, probe, reverse engineer, or bypass security, usage, or access controls, except where law expressly permits;
  • scrape or extract the Service or its outputs at scale without authorization;
  • resell, sublicense, or provide access to the Service except under an authorized commercial arrangement;
  • submit content you are not entitled to use; or
  • use outputs as the sole basis for decisions with legal or similarly significant effects on a person.

We may investigate suspected abuse and remove content, restrict features, suspend access, or report conduct where reasonably necessary.

6. Kino Credits, fees, and taxes

Paid features may consume Kino Credits or be subject to a subscription, order form, or usage limit. Prices, taxes, credit consumption, validity, and included features are shown at purchase or in the applicable commercial document.

Unless required by law or expressly stated at purchase, completed purchases and consumed credits are non-refundable. Failed or canceled generation jobs may be handled according to the credit and retry rules shown in the Service. Credits are not money, are not transferable, and have no cash value except where law requires otherwise.

You authorize our payment processor to charge the selected payment method. You are responsible for applicable taxes other than taxes imposed on our net income.

7. Third-party services

The Service may use or connect to third-party AI providers, hosting and storage providers, payment processors, email services, identity providers, and social networks. When you request a feature or connect an account, relevant data or rendered media may be sent to that provider.

Third-party services are governed by their own terms and policies. We are not responsible for a third party’s independent service, decisions, availability, or content. You are responsible for complying with the rules of any destination where you publish.

8. Intellectual property

Kinoder and its licensors own the Service, software, interfaces, documentation, brands, designs, and other materials we provide, excluding Your Content. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service during your authorized access. No other rights are granted.

Feedback you voluntarily provide may be used without restriction or compensation, provided we do not identify you publicly without permission.

9. Confidentiality

If either party receives non-public information identified as confidential or that reasonably should be understood as confidential, it will use reasonable care to protect that information and use it only for the relationship. This obligation does not apply to information that is public through no breach, already lawfully known, independently developed, or lawfully received from another source. Disclosure is permitted when legally required, with notice where lawful.

10. Availability, changes, and support

We aim to provide a reliable Service but do not promise uninterrupted or error-free operation. Maintenance, provider failures, network conditions, content reviews, security events, or legal requirements may affect availability. Support commitments or service levels apply only if stated in a separate agreement.

We may change the Service and these Terms. Material changes will be notified through the Service, by email, or by updating this page, as appropriate. Changes take effect on the stated date. Continued use after that date means you accept the revised Terms, except where law requires additional consent.

11. Suspension and termination

You may stop using the Service at any time and may request account closure through available account controls or by contacting us.

We may suspend or terminate access if you materially breach these Terms, create legal or security risk, fail to pay amounts due, misuse the Service, or if continued provision is no longer commercially or technically feasible. Where reasonable, we will give notice and an opportunity to cure. Provisions that by their nature should survive termination will survive, including payment, ownership, disclaimers, liability limits, and dispute provisions.

12. Disclaimers

To the maximum extent permitted by law, the Service and all outputs are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising from the Service.

Kinoder’s aggregate liability arising from the Service will not exceed the greater of (a) the amount you paid for the Service during the 12 months before the event giving rise to the claim or (b) USD 100. These limits do not apply where liability cannot legally be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.

14. Indemnity

If you use the Service for business purposes, you will defend and indemnify Kinoder and its affiliates, personnel, and providers against third-party claims, losses, and reasonable costs arising from Your Content, your unlawful use of the Service, or your material breach of these Terms, except to the extent caused by Kinoder.

15. Governing terms and disputes

An order form, enterprise agreement, or other signed agreement may contain additional or different terms. If it conflicts with these Terms, the signed agreement controls for that conflict.

The governing law and forum are those stated in your applicable order form, invoice, or signed agreement. If none is stated, applicable law and the competent forum will be determined under mandatory conflict-of-law and jurisdiction rules. Nothing here limits mandatory consumer protections or your right to contact a regulator or bring a claim where the law allows.

Before filing a formal claim, each party should try in good faith to resolve the matter by contacting the other, unless urgent relief or a limitation period requires immediate action.

16. General

If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, except as part of a permitted business transfer. We may assign them as part of a merger, reorganization, sale, or transfer of the Service.
